We all strongly believe in the value of respect for the right to privacy and confidentiality and at the same time we are aware of the possibility that someone might misuse this freedom for purposes other than those for which our community was born.
The Swarm and those who use it are therefore aware of the following restrictions, also outlined in our terms of service:
- not upload and share illicit content, or content that explicitly incites hatred or violence;
- not use Cubbit Client Software for illegal, deceptive, malicious or discriminatory purposes;
- not violate the law in any way, by not filing, publishing or sharing fraudulent, defamatory or misleading material;
- not violate the privacy or rights of other people, and not upload or share content that infringes third party copyright.
Since we are distributed and encrypted, we are all protected by our infrastructure and how it works on a foundational level. All files on Cubbit are broken and encrypted in multiple shards that do not resemble anything of the original file, they are essentially instructions for reassembly. Since they are not then the actual files that any dubious person may put in the Swarm, they would never truly exist on any of the Cells they traverse through (hence, there is no legal recourse). They could only be reassembled and downloaded by the original uploader who has the encryption keys.
Further, if we are informed or have evidence of a violation to our terms of service, we can permanently suspend or exclude users from the Swarm.
